PART I — TERMS OF SERVICE
1. Acceptance of Terms
By accessing or using any service, platform, website, or application provided by Top Tier Transitions LLC ("Company," "we," "us," or "our") — including the Rightsize client portal at app.toptiertransitions.com — you ("User" or "Client") agree to be bound by these Terms. If you are acting on behalf of an estate or another person, you represent that you have authority to do so.
If you do not agree to these Terms, do not use our Services.
2. Our Services
Top Tier Transitions LLC provides senior move management and estate transition services, including access to a digital client portal for tracking your project. The specific scope, timeline, and pricing of your engagement are governed exclusively by your signed Service Agreement with the Company.
The terms of your specific services, fees, and deliverables are outlined in your signed Service Agreement — not in this document.
3. Account Access
You must be at least 18 years old to use our platform. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@toptiertransitions.com if you believe your account has been compromised. Accounts are for individual use only and may not be shared.
4. Your Data & Content
You retain ownership of any personal information, photos, and property data you or we enter on your behalf. By using the platform, you grant us a limited license to use that data solely to provide your services — including cataloging, routing, vendor coordination, and (where authorized) listing items for sale.
We will not use photos of your property for marketing purposes without your separate written consent.
5. AI Tools
Our platform uses AI to assist with item identification, categorization, and routing suggestions. These are estimates and recommendations only — not professional appraisals or guarantees. All AI-generated suggestions require human review and your explicit approval before any action is taken on your property.
6. Financial Terms
All fees, commissions, payment schedules, sale proceeds, and revenue-sharing arrangements are defined in your signed Service Agreement. Those terms govern. This document does not modify or supplement any financial arrangement you have with us.

7. Acceptable Use
You agree to use the platform only for managing your own project. You may not attempt to scrape, reverse-engineer, or misuse the platform, impersonate others, upload unlawful content, or use automated tools to interact with our system. We reserve the right to suspend access for violations.
8. Third-Party Services
Our platform connects with third-party tools to deliver services (such as payment processing, image storage, email, and messaging). Your use of those services is subject to their own terms. We are not responsible for the actions of third-party providers.
9. Communications
By providing your contact information, you consent to receive transactional messages related to your project — updates, scheduling, approvals, and billing. Marketing communications require separate opt-in consent. You may opt out of SMS at any time by texting STOP. Standard message and data rates may apply.
10. Item Disposition
No item will be donated, sold, consigned, or discarded without your explicit approval. All approvals are logged with a timestamp. Once a physical disposition has occurred, it may not be reversible. Please review all routing recommendations carefully before approving.
11. Intellectual Property
The Rightsize platform, its design, workflows, and related intellectual property are owned by Top Tier Transitions LLC. Nothing in these Terms transfers any ownership rights to you.
12. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, OR ACCURACY OF AI-GENERATED CONTENT. WE DO NOT GUARANTEE THAT ANY ITEM WILL SELL AT A PARTICULAR PRICE OR WITHIN A PARTICULAR TIMEFRAME.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOP TIER TRANSITIONS LLC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRIOR THREE MONTHS OR $500.
14. Indemnification
You agree to indemnify and hold harmless Top Tier Transitions LLC from claims arising out of your violation of these Terms, your violation of applicable law, or inaccurate information you provided to us.
15. Estate & Probate Matters
We do not provide legal, tax, probate, or financial advice. If you are acting as executor, administrator, or power of attorney for an estate, you represent that you have full legal authority to authorize services. Consult licensed professionals for legal and financial matters.
16. Termination
You may request account deactivation at any time by contacting support@toptiertransitions.com. Termination of your account does not affect obligations under any signed Service Agreement. We may suspend or terminate access for violation of these Terms, non-payment, or project completion. We retain your project data for 3 years following project close.
17. Dispute Resolution
Before pursuing any legal action, both parties agree to attempt good-faith resolution within 30 days by contacting support@toptiertransitions.com. If unresolved, disputes shall be submitted to binding arbitration through the American Arbitration Association, conducted in Cook County, Illinois under Illinois law. You waive the right to participate in class action proceedings. Either party may bring qualifying claims in small claims court.
18. Changes & Contact
We may update these Terms at any time. Material changes will be posted on our website and communicated by email where feasible. Continued use of the platform constitutes acceptance.

PART II — PRIVACY POLICY

Top Tier Transitions LLC is committed to protecting your privacy. This Policy explains how we collect, use, and protect your personal information.

5. Data Sharing
We do not sell your personal information. We share data only with vendors necessary to deliver your services, as required by law, or in connection with a business transfer. Mobile opt-in data is excluded from all third-party sharing.
6. Data Retention
We retain your project data for a minimum of three years following project completion for record-keeping and legal compliance. Data subject to a legal hold is retained longer as required.
7. Your Rights
You may request access to, correction of, or deletion of your personal information at any time. To opt out of marketing or withdraw SMS consent, follow the instructions in our communications or contact us directly.

8. Illinois Residents
Illinois residents may have additional rights under the Illinois Personal Information Protection Act (PIPA). Our platform does not collect biometric identifiers. For PIPA-related requests, contact support@toptiertransitions.com.
9. Security
We use reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access or disclosure.
10. Cookies
Our website may use cookies to improve your experience. Cookies do not capture SMS consent or personal identifiers.
